Description

Contractors are sending notices of delay and requesting time extensions due to the COVID-19 virus. Our speakers for this webinar, Scott Lowe and Mark Nagata from Trauner Consulting Services, are already helping their clients evaluate time extensions due to alleged COVID-19 delays. Though most of us have never had to figure out if a contractor is due a time extension for an epidemic, most DOT contracts contemplate these kinds of delays.

In this webinar, we’ll look at the Wyoming, Montana, and North and South Dakota DOT contracts. We’ll discuss what these contracts require regarding a contractor’s obligations to establish entitlement to a time extension for alleged COVID-19 delays. We’ll look at notice. We’ll look at whether COVID-19 delays are excusable under your contract. We’ll discuss why they are not compensable. And we’ll show how to analyze your project’s schedules to quantify the delay, if any, associated with COVID-19. We’ll also identify the documents the contractor must submit and that you’ll need to review to verify and quantify COVID-19 delays, if any.

Mark Nagata is a Director and Shareholder with Trauner Consulting Services, Inc. He is the co-author of the book Construction Delays, Third Edition, and is also a contributing author to the AACE International’s Recommended Practice No. 29R-03 for Forensic Schedule Analysis, the first industry publication that comprehensively classifies all known forensic schedule analysis techniques used to identify and measure project delay. He is an award-winning instructor who has presented claims and scheduling-related seminars nationally and internationally. Mark is also a qualified expert who has provided expert testimony at deposition, arbitration, and trial. He has analyzed schedules and delays on hundreds of construction projects, with a particular focus on highway projects, throughout his career

Scott Lowe, PE, is a Principal of Trauner Consulting Services, Inc. He is the co-author of the book Construction Delays, Third Edition, and is also past Chairman of CMAA’s Time Management Committee, leading the development of CMAA’s scheduling standards and procedures. Mr. Lowe was the lead developer and an award-winning instructor of the National Highway Institute’s seminar “Managing Highway Contract Claims: Analysis and Avoidance.” Mr. Lowe is a qualified expert who has provided expert testimony at deposition, arbitration, and trial. He has also evaluated numerous construction claims for State DOTs across the nation.
